Pursuant to Articles L211-5 and R211-27 of the French Mutual Insurance Code, Groupe UITSEM, a mutual insurance organisation registered under number 330 176 413 and governed by Book II of the French Mutual Insurance Code, whose registered office is at 43 Rue Jaboulay in the 7th district of Lyon, will provide sickness and accident insurance in place of SMERRA-Mutuelle to members of SMERRA-Mutuelle and their beneficiaries, and fulfil all current and future commitments. Groupe UITSEM will stand joint and several surety in relation to all the financial commitments and liabilities – including non-insurance-related commitments and liabilities – entered into by SMERRA-Mutuelle. If its approval is revoked, the insurance cover will end at midday on the 40th day from the date of publication of the relevant decision, and the portion of the contribution paid for the period not covered will be refunded to the policyholder.

(2) Medical expenses will be reimbursed on presentation of a prescription and/or a paid invoice made out in your name and duly certified by a medical professional. All reimbursement amounts are calculated for a period of 12 months. The actual amount that will be reimbursed to you will be calculated in proportion to the number of months for which you have paid into the scheme.
(3) Medical Insurance does not cover the reimbursement of nicotine replacement products. Expenses are reimbursed on presentation of a paid invoice.
(6) Male and female contraceptives are reimbursed on presentation of a paid invoice made out in your name.
(7) Fresh fruit and vegetables are reimbursed on presentation of a paid invoice made out in your name.
(8) Reimbursed on presentation of a paid invoice made out in your name, including the date and time.
(11) Frames, lenses and contact lenses reimbursed by the social security scheme.
(14) The amount reimbursed varies according to the product and level of correction (simple, complex or hyper-complex lenses), see responsible policy. The reimbursement amounts stated are the maximum amounts covered (including frames up to €150 and the patient’s contribution). These amounts are not prorated.
(16) 400% of the ‘TRSS’ reimbursement amount within the limit of the expenses incurred and €4,500 per event. Expenses are reimbursed in accordance with applicable regulations (terms and conditions, exclusions and obligations pursuant to the French Act of 13 August 2004) and the co-ordinated treatment.
(17) Payment of death or permanent disability benefit:
– applicable in case of accidental death whilst engaging as an amateur in the following non-competition sports: athletics, rowing, badminton, base-ball, basketball, billiards, boomeranging, bowls, bowling, canoeing and kayaking (excluding rafting), land-yachting, orienteering, cricket, curling, cycling, cyclo-cross, bike touring, horse riding, fencing, football, American football, golf, gymnastics, weightlifting, handball, hockey and ice hockey, court tennis, swimming, skating, roller skating, Basque pelota, boules, skateboarding, rugby, downhill skiing, cross-country skiing, water skiing, squash, surfing, tennis, table tennis, archery, trampolining, baton twirling, sailing within 5 nautical miles of the coast, volley-ball, water-polo;
-not applicable in case of accidental death due to excess consumption of alcohol or the use of drugs or non-prescribed tranquilizers, or due to any of the following ailments or illnesses other than as a result of an insured accident: mental disturbance, mental health issues, psychological disorders, personality disorders, mood disorders, psychosis, neurotic disorders, stroke, epilepsy, Parkinson’s disease, cerebellar dysfunction, degenerative neurological disorders, aneurysm rupture, ulcers, congestion, frostbite or sunstroke.

How do we determine the periods for which we retain your personal data?

We retain data for the period of time required to carry out the operations for which the data is collected and in accordance with applicable regulations. The period for which we retain data varies depending on the nature and purpose of the data, and the legal and regulatory requirements governing such data. These periods are based on the applicable statutory limitation periods.
We initially retain data according to the term of your policy. The retention period begins when our contractual relationship ends.
Under the general statutory provisions of Article 2224 of the French Civil Code, data must be retained for a period of five years, as ‘Personal actions are subject to a five-year limitation period from the day on which a rightholder was aware of or should have been aware of the facts enabling them to exercise that right’.
Regarding your other data that we do not hold, since the mandatory health insurance scheme was transferred to the CNAM national health insurance fund in 2019, please contact the CNAM for information concerning that scheme.
